These Terms and Conditions (“Terms”) govern your use of the SynergenX Weight Loss website (“Website”) and the services provided therein, including but not limited to scheduling telemedicine appointments for weight loss counseling (“Services”) with our affiliated. By accessing or using the Website and its Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website or its Services.

1. Acceptance of Terms: By accessing or using the Website and its Services, you agree to comply with and be bound by these Terms. These Terms constitute a legally binding agreement between you and SynergenX Weight Loss.
2. Services: The Services provided through the Website allow individuals to facilitate scheduling telemedicine appointments for weight loss consultation. These appointments may involve consultations with healthcare professionals licensed to practice in your jurisdiction.
3. User Accounts: In order to access certain features of the Website and its Services, you may be required to provide contact information as well as information concerning your health. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. Medical Disclaimer: The information provided on the Website, is for informational purposes only and should not be considered medical advice. You acknowledge that the Services provided through the Website are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition.
5. Telemedicine Appointments: Telemedicine appointments facilitated through the Website are subject to availability and may require payment of fees. You agree to provide accurate and truthful information during the scheduling process and during the appointment itself.
6. Refund Policy: Telemedicine Appointments: All weight loss plans begin with a telemedicine assessment.  The cost of the initial assessment is $100, which is a one-time non-refundable payment.  If a previously scheduled appointment is missed, patients can re-schedule the appointment, within 14 days, without paying an additional $100.  If a scheduled appointment is missed and not re-scheduled within 14 days of the originally scheduled appointment, it will be considered cancelled.  Any subsequent scheduled appointments after the 14-day period will require another $100 telehealth fee.
   Prescriptions: All prescription medicine purchases are non-refundable.
7. Prescription Medicine: SynergenX Weight Loss employs qualified healthcare providers to provide telehealth assessments.  Those providers will conduct a review with the patient in order to determine the best weight loss treatment plans available.  Prescriptions prescribed by your provider are priced based on the prescription being filled by our pharmacy partner and will be delivered directly to the address you provide. You do have the option to fill certain, but limited prescriptions at the pharmacy of your choice, but doing so will be at a cost subject to your preferred pharmacy. With the prescription of medications, side-effects and adverse reactions are possible.  Side-effects can vary for each individual and may not occur in everyone. They also depend on the dosage, the duration of use, and any pre-existing health conditions.  By using this website you agree to fully release and hold SynergenX Physician Services (its subsidiaries and affiliates) harmless for any side-effect or adverse reaction you may experience as a result of medication prescribed by a provider. SynergenX Weight Loss is not a medical practice and provides no guidance or recommendation on specific treatments or medications.
8. Privacy Policy: Your use of the Website and its Services is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the Website and its Services, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy.
9. Intellectual Property: All content on the Website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of SynergenX Weight Loss or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Limitation of Liability: To the fullest extent permitted by applicable law, SynergenX Weight Loss shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website or its Services; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; or (iv) unauthorized access, use, or alteration of your transmissions or content.

Indemnification: You agree to indemnify and hold harmless SynergenX Weight Loss, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from or relating to your violation of these Terms or your use of the Website or its Services.
12. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Texas, without regard to its conflicts of law principles. Any dispute arising out of or relating to these Terms or your use of the Website or its Services shall be exclusively resolved by the state or federal courts located in Harris County, Texas.
13. Changes to Terms: SynergenX Weight Loss reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
